However, the Department of Education (DepEd), in coordination with the Commission on Elections (COMELEC), has taken steps to ensure that the public education system remains fully functional.

A recently issued DepEd Memorandum provides a Grant of Continuing Authority for appointing or hiring new employees during the election ban period, which is scheduled from March 29 to May 17, 2025. This move is aimed at maintaining the essential functions of public schools and other DepEd offices across the country.


Why Is There an Appointment Ban?

Under Philippine election laws, the appointment or hiring of new employees in government agencies is generally prohibited during election periods. This is to prevent the use of public resources for political advantage. However, certain exemptions can be granted when the hiring is deemed essential to the normal operations of a government agency.

Recognizing the critical role of DepEd in ensuring uninterrupted education services, COMELEC has allowed an exemption, provided that all necessary conditions and legal requirements are met.

  1. Only essential personnel can be hired

    • All hiring must comply with DepEd’s recruitment, selection, and appointment process, ensuring that only qualified individuals are appointed.

  3. No promotions or salary increases allowed

    • The authority to appoint does not include granting promotions, salary increases, or other employment benefits unless they are part of a previously approved program.

  4. COMELEC oversight is required

    • Proper documentation and compliance with COMELEC regulations are mandatory. DepEd is required to submit reports and justifications for each appointment made during the restricted period.


Who Has the Authority to Sign Appointments?

The signing authority for these appointments has been granted under DepEd Order No. 015, s. 2024, which details the Revised Delegation of Authorities for Human Resource and Financial Matters. This means that specific DepEd officials have the legal authority to sign appointments, ensuring that hiring decisions are made efficiently and in compliance with regulations.


Ensuring Transparency and Compliance

To uphold transparency, DepEd will continue to follow strict screening and evaluation processes before finalizing appointments.
